Disclaimer
This Disclaimer applies to winter.ink (“the Site”), the hub site for the published and professional work of Dr Robert N. Winter and Dr Halaina R. Winter. It should be read alongside the Terms, which form part of the agreement between you and us.
In this Disclaimer, “we”, “us”, and “our” refer jointly to Dr Robert N. Winter and Dr Halaina R. Winter, both of New South Wales, Australia.
What This Site Is
The Site is a portfolio and signposting hub. It introduces our work, describes our current and past projects, and directs visitors to the destinations at which that work is published—at present, robert.winter.ink and the podcast On the Subject of Leadership with Dr Robert N. Winter, and in due course, the projects of Dr Halaina R. Winter as they come online.
Substantive content—articles, podcasts, marginalia, and longer works—is published at those destination sites, and its use is governed by the legal terms published there. Where this Disclaimer addresses content authored by one of us, the principles below apply; for content licensing, copyright, and reader rights, the destination site’s published terms are authoritative.
Views and Opinions
The views expressed on the Site, on the destination sites it points to, in podcasts, in associated social-media channels, and in private correspondence are ours alone. They are not attributable to any board, committee, employer, client, university, or other organisation with which either of us is, or has been, associated in a professional or academic capacity.
Where guests appear on a podcast or are interviewed in any associated work, the views they express are their own and are not attributable to us, to their respective employers, or to any organisation with which they are associated. Appearance is not endorsement.
Nature of the Content
The Site, and the destinations it points to, publish writing and commentary on leadership, governance, organisational life, history, philosophy, and related subjects. Material is offered for general information, intellectual engagement, and professional reflection.
It is not legal advice, financial advice, investment advice, medical advice, tax advice, accounting advice, actuarial advice, or any other form of regulated professional advice. It is not a substitute for advice given by a qualified professional on the particular facts of a particular matter, and it should not be relied on as such. Readers with specific questions affecting their personal, professional, or fiduciary position should consult a suitably qualified adviser.
In particular, material that discusses corporate governance, directors’ duties, fiduciary obligations, regulatory responsibilities, or organisational strategy is not advice on the application of any of those matters to a specific board, company, or engagement. Any reader contemplating action on such matters should obtain independent legal and professional advice.
No Professional Relationship
Visiting the Site, following links from it, subscribing to a destination site, or corresponding with us does not establish a consulting, advisory, or other professional relationship between us. A professional relationship is formed only by the execution of a separate written engagement agreement.
Accuracy and “As Is”
While we take care to ensure that material published on the Site and at our destinations is accurate, well-researched, and properly attributed, we make no warranty of accuracy, completeness, or reliability. The Site is provided on an “as is” and “as available” basis. We expressly disclaim all warranties, whether express or implied, including warranties of fitness for a particular purpose, merchantability, and non-infringement, and we do not warrant that the Site will be free of technical faults, interruptions, or security vulnerabilities.
Nothing in this Disclaimer excludes, restricts, or modifies any consumer guarantee or right that cannot be excluded at law, including under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)).
Third-Party and Linked Content
The Site contains links to external websites—including our own destination sites, third-party publications, social-media channels, and embedded references to third-party works. We do not control third-party content, cannot warrant its accuracy, reliability, or continued availability, and do not endorse it by the fact of linking to or referencing it. You access third-party content at your own risk.
Where the Site links to one of our destinations—for example, robert.winter.ink—the destination’s published terms govern any further use of that destination’s content, and any disclaimer published there applies in addition to this one.
Affiliation, Sponsorship, and Paid Placement
The Site does not carry advertising, does not accept sponsored content or paid placements, and does not use affiliate links. No author, publisher, product, service, or organisation referred to on the Site has paid, or provided anything of value, in consideration for being mentioned. If this position changes, it will be disclosed prominently on this page.
Authorial Work and the Use of AI
Articles, podcasts, scripts, and other published material associated with the Site are our own authorial work in the sense that matters: we stand behind the reasoning, we are accountable for the meaning, and the judgements expressed are ours. Robert’s position on authorship in the age of AI is set out at length in Authorship in the Age of AI, and applies to material associated with this Site.
We use artificial-intelligence tools routinely and without apology—as thinking partners for interrogating ideas, as research assistants for locating and summarising sources, and as copy editors for matters of clarity, rhythm, and grammar. In this we are in step with standard practice in the senior professions, where competent and disclosed use of AI is increasingly treated as part of good professional craft, and its avoidance as a lapse in that craft rather than a virtue.
What does not change is where authorial responsibility sits. The reasoning behind what is published is ours, the judgement that selects and rejects is ours, and the moral burden of belief is ours. AI tools enlarge the workshop; they do not hold the chisel.
Evolving Views
The opinions expressed reflect our views at the time of publication. Those views may evolve as new information becomes available, as we revisit a question, or as circumstances change. Readers should regard each piece as a snapshot of our thinking at the date of publication, and should consider that date when assessing the relevance of a piece to any present question.
Where a view changes significantly and we revisit it in a subsequent piece, an editorial note will be placed at the top of the earlier piece linking to the update. The earlier piece will remain unchanged in substance, so that the historical record is preserved.
Changes to This Disclaimer
We may revise this Disclaimer from time to time to reflect changes in the Site, in the services used to operate it, or in applicable law. The date of the most recent revision appears at the foot of this page. Where a change is material, a prominent notice will be posted on the Site before the change takes effect; minor or clarificatory changes will be published without separate notice.
